These Terms of Use ("Terms") govern your use of LullaCam ("LullaCam" or the "App"), developed and operated by Gevorg Gasparyan ("Developer", "I", "me", or "my").
By downloading, accessing, or using LullaCam, you agree to these Terms. If you do not agree to these Terms, do not use the App.
LullaCam is a baby-monitoring application that allows compatible Apple devices to communicate for live video and audio monitoring.
You may use LullaCam only for lawful purposes and in accordance with these Terms and applicable laws.
You are responsible for ensuring that you have the necessary rights and permissions to use the App and to capture or transmit any audio or video using it. You must comply with applicable privacy, recording, and consent laws.
LullaCam is not a medical device and is not intended to provide medical, health, emergency, or safety-critical monitoring.
LullaCam must not replace direct supervision of a child or appropriate baby-safety practices.
Do not rely exclusively on LullaCam for emergency notifications, medical monitoring, or any situation in which failure of the App, a device, or a network connection could result in injury or other harm.
Audio or video may be delayed, interrupted, unavailable, or lost due to device limitations, network problems, permission settings, background operation restrictions, or other technical issues.
You are responsible for determining whether LullaCam is appropriate for your particular situation and for maintaining suitable alternative supervision and safety measures.
LullaCam requires compatible Apple devices and supported operating system functionality.
The Camera and Monitor generally need to be connected to the same local Wi-Fi network for local monitoring.
Performance and availability may depend on your devices, operating systems, Wi-Fi network, network configuration, permissions, and other factors outside the Developer's control.
You are responsible for maintaining compatible devices and a suitable network connection. The Developer does not guarantee uninterrupted connectivity or successful transmission of audio or video.
LullaCam may request access to the Camera, Microphone, and Local Network to provide its functionality.
You can manage permissions through your device settings. If required permissions are denied or restricted, some or all App functionality may not be available.
LullaCam may offer auto-renewable subscriptions and a one-time lifetime purchase. The available products and features may change over time.
Purchases made through the Apple App Store are processed by Apple using your Apple Account.
For auto-renewable subscriptions:
The subscription name, duration, localized price, and any applicable price per unit are displayed in the App before purchase. The terms shown on the purchase screen at the time of purchase apply to your transaction.
Prices may vary by country or region and may change over time. Any applicable price change to an existing subscription will be handled in accordance with Apple's policies and applicable law.
Deleting the App does not automatically cancel an active subscription. You must cancel the subscription through your Apple Account settings if you do not want it to renew.
Where available, the lifetime purchase is a one-time, non-renewing purchase that provides access to the applicable premium functionality described in the purchase interface.
A lifetime purchase does not renew automatically and does not incur recurring subscription charges.
"Lifetime" refers to the lifetime of the applicable App or product offering. It does not guarantee that LullaCam, a particular feature, or any service will be available indefinitely.
Purchases made through the Apple App Store are processed by Apple. Refund requests must be submitted through Apple's applicable refund process.
The Developer cannot directly issue refunds for App Store transactions. Refund eligibility is determined in accordance with Apple's policies and applicable law.
LullaCam, including its software, design, graphics, text, branding, and other original content, is owned by or licensed to the Developer and is protected by applicable intellectual property laws.
Except where permitted by applicable law or authorized by the Developer, you may not copy, modify, distribute, sell, sublicense, reverse engineer, or otherwise exploit the App or its content.
The Developer may update, modify, suspend, or discontinue features of LullaCam where reasonably necessary, subject to applicable law.
The Developer does not guarantee that the App or any particular feature will always be available, uninterrupted, secure, or error-free.
Updates may be required to continue using certain features.
LullaCam may rely on Apple services, the Apple App Store, StoreKit, and operating-system functionality.
Third-party services are governed by their own terms and policies. The Developer is not responsible for third-party services to the extent permitted by applicable law.
To the maximum extent permitted by applicable law, LullaCam is provided on an "as is" and "as available" basis, without guarantees that the App will always operate without interruption, delay, or error.
To the maximum extent permitted by applicable law, the Developer will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, arising from or related to your use of, or inability to use, LullaCam.
Nothing in these Terms excludes or limits liability, consumer rights, or other protections that cannot legally be excluded or limited under applicable law.
Your use of LullaCam is also governed by the LullaCam Privacy Policy.
The Privacy Policy explains how LullaCam handles information and device permissions. Please review it before using the App.
You may stop using LullaCam at any time by deleting the App from your device.
The Developer may discontinue the App or certain functionality where reasonably necessary, including for security, legal, technical, or operational reasons, subject to applicable law.
Termination or deletion of the App does not automatically cancel an active subscription. Subscription cancellation must be managed through your Apple Account settings.
These Terms may be updated from time to time.
The updated Terms will be published at this URL with a revised "Last updated" date. Where required by applicable law, notice or consent will be provided for material changes.
These Terms are between you and Gevorg Gasparyan, the developer of LullaCam, and not Apple. The Developer, not Apple, is responsible for LullaCam and its content, maintenance, support, and any applicable warranties, to the extent required by applicable law.
Apple has no obligation to provide maintenance or support services for LullaCam.
To the maximum extent permitted by applicable law, Apple is not responsible for addressing claims relating to LullaCam, including product liability claims, claims that LullaCam fails to comply with applicable legal or regulatory requirements, or claims that your use of LullaCam infringes a third party's intellectual property rights.
Your use of LullaCam must comply with any applicable third-party terms when using third-party services.
Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
